General information
Charitable organization "Ty-Angel Charitable Foundation" (hereinafter "the Foundation"), understanding the importance of ensuring the confidentiality and integrity of Personal Data of individuals, enters into this Confidentiality Agreement (hereinafter the "Agreement") with you (hereinafter the "User") to determine the order of receipt, storage, processing, use and disclosure by the User's Personal Data Fund when the User uses the Internet site tyanhel.org.ua (hereinafter "Site").
To use the Site and its features, the User is obliged to accept the terms of this Agreement. The user has no right to use the Site and opportunities for engagement and provision charitable assistance provided by the Site (hereinafter - Opportunities), in case of disagreement with the terms of this Agreement.
Users of the Site agree that in order to comply with the requirements of the Law of Ukraine "On the Protection of Personal Data", the Foundation has the right to include personal data provided by users, to the personal data base, for the processing of such personal data and, as necessary, caused by the fulfillment of the conditions of the specified law, for the transfer of such personal data to third parties.
Deadlines
Personal data – information about a specific User that allows identification of this User as an individual.
Publicly available data - information (including Personal data) to which a natural person - the owner of this data, granted access to an unlimited number of persons (including by publishing on any Internet site without restricting access to this data) or to which, in accordance with this Agreement and/or the current legislation of Ukraine, the requirement to observe confidentiality does not apply.
Account – a set of information about the User, containing the User's authorization data (login and password), necessary for the User's identification when using the Site and Services.
Cookie - a piece of data created by the Site and saved on the User's computer in the form of one or more files. Cookies do not contain Personal Data and can be blocked by the User at any time.
1. Subject of the agreement
1.1. This Agreement defines the procedure for receiving, storing, processing, using and disclosing Personal, Public and other data provided to the Fund by the User when
his use of the Site and Features.
1.2. By using any part of the Site and Features, the User grants the Foundation the right to receive, store, process, use and disclose the User's Personal Data on
under the terms of this Agreement.
1.3. This Agreement does not regulate, and the Fund is not responsible for the procedure for receiving, storing, processing, using and disclosing the User's Personal Data by third-party enterprises and organizations that are not owned or controlled by the Fund, and individuals who are not employees of the Fund, even if the User gained access to the sites, software, goods or services of these persons using the Site.
1.4. The purpose of receiving, storing, processing and using the User's Personal, Public and other data is to protect the interests of the User and the Site, as well as providing User Features, including displaying targeted, personalized or general information, improving the quality of existing and creating new sites and features provided by the Site.
2. Receiving, processing and using information
2.1. When creating an Account, the User must specify authorization data, as well as name, surname, public name, e-mail address and other data. After the creation of
the User's use of the Account allows the Fund to identify the User each time he uses the Site.
2.2. The Foundation has the right to download cookie files to Users' computers (if the User has not limited this possibility in their web browser), as well as to receive
store, process and use information contained in cookies.
2.3. When the User uses the Site and the Features of the equipment on which the Site is located, the Site automatically stores, processes and uses the User's data, which is not are Personal, for example: the User's IP address, geolocation - data about the User's location that can be determined using his IP address, UTM parameters,
technical parameters of the User's computer, presence or absence of specific software on the User's computer, settings of this software,
cookie files, as well as statistical information about the User's activity.
2.4. The Fund has the right to store the User's Personal, Public and other data in the amount and in the time period necessary for the implementation of the purpose specified in this Agreement, or in the time period, established by the current legislation of Ukraine, the norms of international law, or the legislation of the country of residence or stay of the User, or until the moment of removal by the User these data.
2.5. In the event of a change in Personal Data, the User must provide the Foundation with updated data by making appropriate changes to the Account on the Site. In case of failure by the User of this requirement, the Fund is not responsible for adverse consequences related to the processing of such Personal Data.
3. Access to information
3.1. The Fund undertakes not to provide Personal Data to third parties for commercial purposes without the consent of the User to whom these data belong. Transfer of Personal Data to third parties for the implementation of the Foundation's statutory activities and the fulfillment of our obligations under concluded transactions is allowed in the following cases:
- after receiving the consent of the User to whom this information belongs;
- if it is necessary to transfer Personal data for the purpose of fulfilling obligations, carrying out statutory activities of the Fund or the User's request;
- upon justified requests of state bodies that have the right to receive such data;
- if, in the opinion of the Fund, the User violates the terms of this Agreement and/or other contracts and agreements between the Fund and the User.
3.2. The User allows the Fund to grant permission to other companies with which the Fund has entered into relevant agreements, to receive, store and process data about the User (except for Personal Data), such as the User's IP address, cookie files, as well as statistical information about the User's activity to improve the quality of services provided by these companies and advertising information character;
3.3. The user agrees that the confidentiality of data transmitted via the Internet is not guaranteed even if access to this data is obtained by third parties outside the zone
technical means of communication under the control of the Fund, the Fund is not responsible for the damage caused by such access.
3.4. The User has the right to request, change or delete his Personal Data accessible by the Foundation. For this, the User must submit a corresponding request by sending it to the Foundation's contact address info@tyanhel.org.ua, if another independent way of requesting, changing or deleting Personal Data is not provided for by the technical capabilities of the Site. In the subject of the letter, it is necessary to indicate "Removal / change of personal data", and in the body - your contact data and user ID on the Site tyanhel.org.ua. If your request was not satisfied within 30 days, you can submit a complaint to the regulatory body - the Commissioner for Human Rights of the Verkhovna Rada of Ukraine at hotline@ombudsman.gov.ua.
3.5. Some services of the Site provide for making and/or receiving payments for the benefit of charitable projects and statutory activities of the Foundation with the help of third-party payment systems, which are not subject to the Fund and have their own terms of use and privacy policy.
4. Additional conditions
4.1. The Foundation has the right to make changes to this Confidentiality Agreement. All changes made to the Agreement will be available in the form of a new edition of the Agreement, at the address and in the case of making Agreement of significant changes, the Fund will additionally notify the User about these changes by e-mail, which is specified in the User's Account. All changes to the Agreement take effect from the moment their publications. By using the Features or the Site, the User confirms his agreement with the new terms of the Agreement in the version in effect at the time of the User's use of the Features and/or the Site.
4.2. The Fund is not responsible for damage or losses suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Agreement, instructions or instructions on the procedure for using the Site, on the procedure for posting data and other technical issues. Before accepting the terms of this Agreement, any User has the right to apply to Fund to obtain clarifications regarding the provisions of the Agreement.
4.3. In the event that any part of this Agreement is declared invalid or unenforceable, the other parts of the Agreement remain valid. Waiver by either party of any term or condition of this Agreement, or any breach thereof shall not invalidate this provision or condition.
4.4. The legislation of Ukraine applies to this Agreement and the relations between the Fund and the User arising in connection with the use of the Site. Each party irrevocably agrees with the fact that the relevant courts of Ukraine have exclusive jurisdiction over any claims, disputes or disagreements related to the Agreement and the use of the Site.
5. Your rights
According to the Law of Ukraine "On Personal Data Protection" you have the right to:
- to know about the sources of collection, the location of your personal data, the purpose of their processing, the location or place of residence (residence) of the owner or manager of personal data data or give an appropriate mandate to receive this information to persons authorized by him, except for cases established by law;
- receive information about the conditions for providing access to personal data, in particular information about third parties to whom your personal data is transferred;
– to access your personal data;
- receive no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, an answer about whether your personal data is being processed, as well as receive the content of such personal data;
- present a reasoned demand to the owner of personal data with an objection to the processing of his personal data;
- make a reasoned demand for the change or destruction of your personal data by any owner and administrator of personal data, if this data is processed illegally or is
unreliable;
– to protect your personal data from illegal processing and accidental loss, destruction, damage in connection with deliberate concealment, failure to provide or untimely provision of them, as well as to protect against the provision of information that is unreliable or disgraces the honor, dignity and business reputation of a natural person;
- file complaints about the processing of your personal data to the Human Rights Commissioner of the Supreme Council of Ukraine or to the court as specified in this agreement;
- apply legal remedies in case of violation of the legislation on personal data protection;
- enter a reservation regarding the limitation of the right to process your personal data when giving consent;
- withdraw consent to the processing of personal data;
- know the mechanism of automatic processing of personal data;
– to protect against an automated decision that has legal consequences for you.
If you are located in the EU, under the GDPR you have the right to:
– request access to your personal data stored by us, their deletion or correction;
– to be informed about the processing of your personal data;
– limit the processing of your personal data;
– on the portability of your personal data;
– object to the processing of your personal data;
- file a complaint with the appropriate supervisory body.
